What is HOPA and Why is it Important?

The Housing for Older Persons Act (HOPA) of 1995 is crucial for communities seeking a 55+ exemption status. HOPA was enacted to encourage the development of housing specifically for older adults, promoting independence while ensuring community support. To comply, at least 80% of the occupied units must consist of at least one resident who is 55 or older; this is consistent with the Federal requirement.

We maintain this requirement by monitoring records and sending out notices to ensure compliance with the renewal process every two years. The Age Verification survey must be updated biennially from the last submission or whenever there is a change in household composition. We accept various forms of identification, such as driver’s licenses and passports, to verify the name and date of birth of respondents.

It’s important to note that failing to meet HOPA requirements can lead to the loss of the 55+ designation and the community can no longer advertise or operate as an age-restricted community, affecting the community’s reputation and desirability.

Who is considered a resident?

Any individual over the age of 19 qualifies as a resident, provided at least one household member is at least 55 years old. To be recognized as a resident, an age verification form must be submitted with current information, and the individual must be living with the homeowner for at least six months to access our amenities. Once the proper documentation is received, all residents should have access to amenity spaces including Fitness and Pool Facilities, Sports Courts, Independence Hall, and the Grand Central area.
